Yes. Vague terms aren't "flexible," they're unenforceable. When you try to withhold a commission for a violation that isn't clearly written down, you lose the dispute and look like the bad actor.
What your terms must spell out:
— Prohibited methods, named explicitly: brand bidding, cookie stuffing, incentivized traffic, trademark+coupon, spam.
— Exactly what triggers a clawback and on what timeline.
— Approved promotional channels and any restricted geos.
— The consequence ladder: warning, commission reversal, removal — so enforcement isn't arbitrary.
Caveat: don't copy a generic terms template and walk away. The worst clauses are ones you wrote, never enforce, and can't explain — partners learn fast which rules are real. Write only rules you'll actually act on, and apply them consistently to everyone.
