Platform labels like "Paid Partnership" often fail the "clear and conspicuous" test. Regulatory standards require disclosures to be unavoidable. System tags often appear in small fonts or areas where UI elements overlap. If a viewer can easily overlook the label, it is legally insufficient.
On mobile, captions are truncated; if a user must click "more" to see #ad, the disclosure fails. Similarly, labels that disappear after a few seconds are ineffective if the promotion continues. The disclosure must stay visible long enough for the viewer to process the message.
Effective disclosure should be both visual and audible. Since many watch with sound off or listen without looking, relying on a platform tool is risky. Hard-code a text overlay like "Ad" onto your video and mention the partnership verbally to cover all user habits.
Place disclosures within the video frame to ensure compliance remains intact regardless of platform layout changes or hidden descriptions.
