FTC compliance is only the baseline: check these state and platform rules too
An FTC disclosure does not override stricter state requirements or a platform’s own policies. The relevant rules may depend on where your audience is located, not only where your business operates.
Before publishing, check four layers:
— State consumer-protection rules on deceptive claims, testimonials, sweepstakes, and automatic renewals.
— Privacy and consent requirements for tracking pixels, email, SMS, and data collection.
— The advertiser’s program terms, including approved claims, traffic sources, and required wording.
— Platform rules for paid partnerships, affiliate links, landing pages, and commercial content labels.
Make the disclosure visible where the endorsement appears. A platform label may help, but it should not replace clear language such as “I may earn a commission if you buy through this link.” Keep screenshots, approval records, and the exact creative used.
Treat every campaign as a three-part review: FTC baseline, state exposure, and platform policy. That checklist catches gaps before traffic does.
