Exclusive vs non-exclusive: content rights structure
The exclusivity clause is a pricing lever, not a checkbox. Route it:
— Brand wants to block competitors from the same creator? Exclusive. Charge a 50 to 100 percent premium and cap it to your category, time-boxed to 3 to 6 months.
— Brand just needs to run the asset? Non-exclusive. Cheaper, and the creator keeps reusing their own footage.
— Creator's first job with you? Non-exclusive only. Don't lock a relationship you haven't tested.
Tradeoff: exclusivity wins bigger fees but shrinks the creator's other income, so price it fairly.
Framework: Charge for the Block, not the Clip. Save this rights router and put exclusivity terms on every contract line.
